Elian part 2, here we go

Babalu contributor Robert has posted about the 4-year old girl who has been the subject of a custody case. It's now getting very interesting because it's just been revealed that the family at the center of the now quickly-developing storm is not just any old Miami family. It's the family of Joe Cubas.

Cubas has made his living (at least at one time) chasing the Cuban national baseball team around the world convincing players to defect. He then represented many of these players as their agent. The way Cuba treats its sports teams can anyone believe that it's a coincidence that this little girl's father suddenly appears in the US to claim a child that doesn't even recognize him? Questions abound like who is paying for the birth father's extended stay in the US, who is paying for his lawyer, who is paying for his expert witnesses?

This case is really complicated. The Cubas family is acting as the foster family for the girl and has already adopted the girl's 13 year old half-brother. Both children came almost two years ago with their mother who has is having psychological problems and given up her parental rights to both kids.

But this smells of vendetta to me. The regime is lashing out at Cubas by dragging his family through this court case. It wouldn't be the first time the regime acted out of spite. The case of Jose Contreras, the major league pitcher who defected several years ago, is well documented. The castro regime refused to give his wife an exit visa despite the fact that she had a visa to enter the US. It's been reported that paid several hundred thousand dollars to have her and his kids smuggled out of Cuba.

The birth father's lawyer is Ira Kurzban, the husband of Magda Montiel, who I had just posted about yesterday because she was quoted in Time.com as supporting Barack Obama's stance about lifting the travel restrictions but she's infamous for kissing fidel castro and calling him a great leader.

We're going to be hearing a lot about this. The Herald got its wish, a huge international story complete with an opportunity to mock the exile community.

To me it´s simple. No child living in freedom should be sent to Cuba, period. Too bad it´s wrapped in a maze.

Hey, am I losing my mind or did I see the mother on Spanish TV saying she wants the father to have the little girl? Did any of you guys watch that?
But isn't the mother whacked out? How can the opinion of someone who tried to commit suicide and who gave up her children have any weight?

The judge should take that into consideration. She's not stable. She did sign away her parental rights. I'm sure she'll have to take that into consideration too.

Coño, Henry, you had to put up cara de caballo again? I almost puked. I can just imagine her with a bridle and saddle. Giddy up. By the way, Magda Montiel called Castro "my teacher" when she kissed his. . . Her husband Ira Kurzban has been on Castro's payroll for nearly three decades.

This has some of the ingredients to be another big mess, but with one major difference: the U.S. courts are actually handling the case as opposed to the Elian fiasco. Also, the case has been handled mostly in private so community involvement has been negligible (how many demonstrations have we seen for/against the girl staying in the U.S.?)

The Herald and a few others out there are dying for this to be Elian: The Sequel (the Herald must have jumped for joy when they first found out Cubas was a central figure in this case). As hard as they may try, the facts and circumstances don't match up.

Definitely, I agree with you, this has Castro stamp of vengeance on it. The Cuban government [that is to say Fidel Castro] is the most vengeful and petty government/"head-of-state" in the world. The best way to define it is a mafia not a government. Governments rise above petty personal grievances and run a a macro level, Castro is concerned with reeking vengeance on individual private citizens. Let's not forget the Nuevo Herald [false] scandal after that Cuban American journalist from el Herald embarrassed the tyrant in Argentina by asking him about that Cuban brain surgeon that is not allowed to migrate to Argentina. It was the Cuban government that started talking about the "moonlighters" before Corral picked up the story.

Castro hates Joe Cubas with a vengeance. The man has embarrassed him repeatedly by facilitating the escape of his best baseball players [read this as slaves].

Yep, this has Castro's stamp of petty vengeance on it.

I would have agreed with you before. But let's take a look at the facts. This case was happening and the entire community was blissfully unaware of it before the Herald decided to get involved. Then the Herald did get involved with a law suit. Now the judge lifts the gag order. And supposedly the trial will begin in earnest on Monday. What do you think that atmosphere will be like?

Again what makes this suspect is who the family is. A lot of big machinery is being moved into place and one has to ask, who is it benefitting?

Absolutely, Joe Cubas being involved does complicate matters. Also, we now know that our friend (and fifo's) Magda is directly involved. Where I draw the distinction between this case and Elian is the way in which it's been handled up to now. Making it public does open up the possibility of a mess, but I think (or maybe it's I hope) that the courts will make a decision that takes into consideration both sides, unlike Elian where the courts never really got involved until it was too late. Most rational people would accept that.
